OPEN DECKS AT THE WAREHOUSE. COMPETITOR AGREEMENT Version 1.3 1. ENTRY IS NOT A SPOT. Signing up enters you into a draw. It does not reserve you a set, guarantee you will perform, or entitle you to any prize. Competitors are selected at random from the entrants for each Wednesday night. 2. YOU MUST BE PRESENT TO BE DRAWN. Names are drawn from the people in the room. To be drawn on an OPEN DECKS night you must be present at The Warehouse, at the Tavern on Blake Street, Denver, that night. If you are not there when your name comes out, your place goes to another entrant and you may be returned to the pool or removed from the competition at the organisers' discretion. 3. ONCE YOU ARE ON THE BOARD, SCHEDULED NIGHTS ARE MANDATORY. After you have been drawn and placed on the board you do not need to attend the remaining OPEN DECKS nights, you are already in the competition, and you are welcome but not required. Any night you are scheduled to compete on, including challenger nights, knockout rounds and the final, is different: attendance is required. The organisers will tell you which nights those are with reasonable notice. Failing to appear on a night you are scheduled for forfeits that round and may end your season, at the organisers' discretion. 4. YOUR SET. An OPEN DECKS set is twenty minutes. That is the time you have, and sets may be cut short if you overrun. There is no required genre or style: get on and show what you can do. 5. THIS IS A COMPETITION, NOT A BOOKING. You are not paid to compete. There is no fee, no guarantee, and no expectation of payment for any night you play in this series, at any stage, including the final. What you are competing for is the prize described below. Bring your people, who turns up for you is part of how this is scored. 6. ELIGIBILITY. You must be 21 or over. Staff of Tavern and their immediate families may not compete for the prize. 7. HOW THE SEASON RUNS. Season 1 runs over eleven weeks. Weeks 1 to 4 are OPEN DECKS weeks, where competitors are drawn and perform. Week 1 ran as a single night. From week 2 each OPEN DECKS week runs two nights, Wednesday and Thursday, and both nights of a week form one field competing on one board. Weeks 5 and 6 are challenger nights, where you move up or down the rankings. Weeks 7 onward are knockout rounds, narrowing the field: week 7 the top 100, week 8 the top 50, week 9 the top 25, week 10 the top 10, and the final in week 11 between the top 5. 8. THE BRACKET. From the knockout rounds the field is drawn into a seeded bracket, in the way a sports tournament is: the highest seed meets the lowest. Your seed is your ranking going in, so climbing early is an advantage. Once a knockout round has begun, losing a match ends your run for the season. 9. VOTING. During the OPEN DECKS rounds (weeks 1-4), voting runs on the week rather than on the individual night. For each week from week 2 onward, voting for every competitor drawn that week opens at 9:00 AM Mountain Time on the Friday following that week's nights and closes at 9:00 AM Mountain Time on the following Monday. Competitors drawn on the Wednesday and competitors drawn on the Thursday share that one window and are ranked together, so that nobody gains an advantage from the night on which they were drawn. There is no voting during the performances themselves. Week 1, which ran as a single night, used a seventy-two hour window opening when that night ended; its results are final and are not affected by this clause. The organisers may adjust a week's voting window and will publish any such change on the competition website. After the OPEN DECKS rounds end, voting opens up continuously for all remaining competitors and runs without interruption until the end of the competition. Eliminated competitors are removed from the voting list. Voting is once per person per day. The organisers may remove votes they determine to be fraudulent or automated. 10. POINTS FOR WHO YOU BRING. Guests are asked at the door which competitor they came to see. You are awarded points for each guest counted for you at the door, in addition to any vote that guest may cast. The points value per guest, and any cap on it, is set by the organisers and may be adjusted between rounds. Door counts depend on guests giving your name when their ID is checked, and the organisers' count is final. 11. JUDGING AND BONUS POINTS. From the knockout rounds onward, judges appointed by the organisers may award additional points on criteria including crowd engagement and holding a room. The criteria, the scoring, and any other bonus points available will be announced before the round they apply to. Judges' decisions are final. 12. RULES STILL TO COME. The detailed rules for the challenger and knockout rounds will be published after week 3. This is deliberate: the organisers need to see the size of the field first, and reserve the right to add nights, change the number of competitors in a round, adjust the schedule, or otherwise grow the competition. Any such rules will be published before the round they apply to and will not change the result of a round already completed. 13. RESULTS. Final vote counts will be published at the end of the competition. The organisers' decision on rankings, points, and results is final. 14. CONDUCT. The organisers may disqualify any competitor for abusive behaviour, harassment, threats, damage to property, or conduct that endangers anyone in the room. This decision is final. 15. EQUIPMENT. You will treat the venue's equipment with care and follow the directions of venue staff at all times. You are responsible for damage you cause through misuse, negligence, or intoxication. Do not modify, unplug, or reconfigure house equipment without a staff member present. 16. THE GRAND PRIZE. The grand prize is $12,000, paid as a booked gig of $1,000 per month for twelve months. It is not paid in advance and no part of it is payable up front. Each monthly payment is earned by performing the booked gig for that month. Dates are scheduled by agreement between you and the venue, and the venue will offer you a reasonable opportunity to perform each month. If you do not perform a scheduled gig, that month's payment is not earned, except where the venue cancels or is unable to provide a date. The grand prize is not transferable. 17. OTHER PRIZES. In addition to the grand prize, the organisers expect to award over $20,000 in total prizes across the season. These additional prizes vary from night to night and may take any form the organisers choose, including but not limited to equipment, merchandise, goods, services, performance opportunities, or cash. They are awarded at the organisers' sole discretion, are subject to availability, and no particular prize, category or value is promised to any competitor. Any stated total is an estimate of the overall value of prizes across the season and is not a sum payable to any individual. 18. TAXES. You are responsible for any taxes arising from any prize or payment you receive. Where required, the organisers may ask for tax information before a payment is made. 19. RECORDING, PHOTOGRAPHY AND YOUR NAME. You agree that the organisers may photograph, film and record the nights, and may use your stage name, likeness, image, and the photograph and links you submit to promote OPEN DECKS and The Warehouse, in any medium, without further payment. You confirm you have the right to submit the photograph you upload. 20. THE PHOTOGRAPHER, AND BUYING YOUR OWN COPIES. A photographer engaged by the organisers may attend competition nights to take photographs and video. If you perform on a night that is covered, you may buy a licence to use the material from your own set, at a price and on terms offered at the time. Buying a licence lets you use that material to promote yourself on any platform you choose, for as long as you like. It does not transfer copyright, which stays with the photographer or the organisers as their arrangement provides, and it does not cover material of other competitors. You are not required to buy anything, and whether you do has no bearing on the competition, the draw, or the result. The organisers keep their own right to use the material as set out above whether you buy a licence or not. 21. YOUR MUSIC. You are responsible for the material you play and for holding any rights or licences your performance requires. You keep all rights in your own original work. 22. YOUR INFORMATION. Your contact details are used to run the competition and to reach you if you are drawn. Your stage name, photograph, music keywords and links may be shown publicly if you are drawn and placed on the board. Your legal name, email address, phone number and this signature are not published. 23. CHANGES AND CANCELLATION. The organisers may change the schedule, the format, or these terms, or cancel the competition, for reasons including venue availability, safety, or insufficient entries. Material changes to these terms will be issued as a new version and will not alter an agreement you have already signed. 24. ASSUMPTION OF RISK AND RELEASE. You take part at your own risk. To the fullest extent permitted by Colorado law, you release Tavern, The Warehouse, and the organisers from claims for loss, injury or damage arising from your participation, except where caused by their own gross negligence or wilful misconduct. 25. GOVERNING LAW. This agreement is governed by the laws of the State of Colorado. 26. ELECTRONIC SIGNATURE. By typing your full legal name below and submitting this form you are signing this agreement electronically. You agree that this electronic signature has the same legal effect as a handwritten one, that you have read and understood these terms, and that the information you have given is true. A copy of this exact text is stored with your signature, together with the date, time and network address it was submitted from.
